PatientsForStemCells.org has filed a complaint with Consumer Watchdog against the FDA for ruling that our own stem cells are drugs. Delaying access with years of drug trials, condemns millions to death or disability.

Patients For Stem Cells is happy that Consumer Watchdog is appealing the case over embryonic stem cell patents held by Wisconsin Alumni Research Foundation (WARF). Since the BTCA gene case, all stem cell isolation patents that depend on identifying a new part of nature (like embryonic stem cells) are on legal quicksand. Based on that case alone, this WARF patent is certainly invalid. But we want to alert CW that the FDA is working hard to protect the interests of stem cell academic scientists and big pharma in another way: limiting the competitive threat posed by our own adult stem cells. The FDA did this by ruling our cells are drugs, when they are expanded in a lab to a therapeutic dose. This stopped physicians who were already savings lives with this safe therapy, and forced sick patients back into to stem cell tourism. Now this therapy will be delayed the many years that it will take to get through FDA drug trials. Our efforts so far, seem to be falling on deaf ears. We would like to launch a class action lawsuit of patients vs. the FDA to enact the reforms listed in our post. Also, we will have the support of Mary Ann Chirba, JD. She is the professor at Boston Law College who's remedies we quote in our post. In order to do this, we need a group such as CW to support and help us. Is this a possibility?
